While I largely agree with Shiar I must take issue with the following.

We all know that at least one list is not open, the one where legal issues
are discussed privately among a few. Then there are those little IRC
get-togethers that happen from time to time. Goodness knows what else goes
on behind closed doors and by private email, which may or may not be
necessary but please don't deny it.

I was put on emergency moderation for daring to go public about an item of
mine that was deleted, as opposed to being hidden, and am still subject to
moderation on one or two lists because of it. I was also deemed to be too
untrustworthy to take a more active role in admin as a result. All of
which can hardly be described as open and public or welcoming.
