10th GLBT Pride Parade Hits the Streets of São Paulo

It took two months of intense negotiations, with various obstacles from
the São Paulo City Hall to gain control of the parade. Following 35 days
of protests, the Parade Association was obliged to sign an adjusted
conduct agreement (TAC) in order for the parade to go ahead. This
agreement complicates future parades in Paulista, makes the Parade
Association responsible for cleaning the public streets and footpaths and
sets a fine of R$30 000 for infringing the timetable or terms of the TAC.
City Hall threatened to take responsibility for the TAC with help from
contractors, in a clear attempt to gain political control of the parade.

Once the Parade Association had signed the TAC, CET (Engineering and
Traffic Company) still tried to block the parade by charging a fee of
approximately R$80 000, which has still not been negotiated and would
create a lot of work for organisers, who do not have the funds, and will
need to respond via legal avenues.

Even so, the parade went ahead, with the theme “Homophobia is a Crime:
Sexual Rights are Human Rights!” It attracted around 2.5 millions people,
fulfilling the terms of the TAC, with collaboration from the GLBT
community who showed solidarity throughout the parade.

Those who did not comply with the terms of conduct were City Hall
themselves; instead of guaranteeing the minimum security and first aid
requirements as requested numerous times by organisers, City Hall opted
for investing resources in a band from its Sexual Diversity Department, a
VIP area with two 24” televisions, and a stage for the press. The
association was not informed of any of these. Volunteers from the Parade
Association themselves at one stage had to help the few ambulances present
and provide first aid to those who became ill during the march.

Once the parade had ended, the antagonistic relationship with São Paulo
City Hall continued, with a refusal of rights to the city and legitimate
occupation of public spaces, declaring “there should be no more parades in
Avenida Paulista.” It appears that things will not be so easy; the parade
chanted, “Paulista is ours”, demonstrating the determination of the GLBT
community to continue occupying public spaces.

Foram dois meses de intensa negociação, com impedimentos das mais diversas
formas da Prefeitura da Cidade de São Paulo para tomar o controle da
Parada. Há a 35 dias da manifestação, a Associação da Parada foi obrigada
a assinar um Termo de Ajuste de Conduta (TAC) para ter a sua realização
autorizada. Esse termo dificulta a realização das próximas Paradas na
Paulista, responsabiliza a Associação da Parada pela limpeza das vias
públicas e estabelece multa de R$ 30.000,00 para qualquer infração de
horários ou termo descumprido do TAC. A Prefeitura chegou à ameaçar que
assumiria todas as responsabilidades contidas no TAC com a ajuda de
empresários, numa clara tentantiva de assumir o controle político da
Parada.

Assinado o TAC pela Associação, a CET (Companhia de Engenharia de Tráfego)
ainda tentou impedir a Parada cobrando uma taxa de aproximadamente R$
80.000,00 para a sua realização, que ainda não foi flexibilizada e deve
custar muito trabalho aos organizadores, que não têm recursos para o
pagamento da mesma e devem agir judicialmente nesse sentido. Mesmo assim,
a Parada saiu, com o tema "Homofobia é Crime: Direitos Sexuais são
Direitos Humanos!", e reuniu cerca de 2,5 milhões de pessoas, cumprindo o
que foi estabelecido por meio do TAC, com a colaboração da comunidade
GLBT, que se mostrou solidária durante toda a Parada. Quem não cumpriu o
estabelecido foi a Prefeitura: ao invés de garantir o mínimo de efetivo de
segurança e atendimento médico necessário e solicitado inúmeras vezes
pelos organizadores, a prefeitura preferiu investir recursos num trio
elétrico da sua Coordenadoria da Diversidade Sexual, numa área VIP com 2
TVs de 42", e num palco utilizado pela imprensa, sendo que ambos não foram
sequer comunicados à organização. Os próprios voluntários da Associação da
Parada se desdobravam, a certa altura, para auxiliar as poucas ambulâncias
a prestar primeiros-socorros para quem passava mal durante a manifestação.

Terminada a Parada, continua uma relação conflituosa com a Prefeitura de
São Paulo que, na mesma linha que vêm seguindo, negando o direito à cidade
e a ocupação legítima do espaço público, já declarou que "não deve haver
mais parada na Av. Paulista". Parece que não vai ser tão fácil assim: a
Parada saiu aos gritos de "A Paulista é nossa", mostrando a disposição da
comunidade GLBT em continuar ocupando os espaços públicos.
